1. The agreement
These Terms of Service are a contract between you and Neo Tomes Inc, operating as SPH Studios covering your use of Circle Back. By playing, you agree to them. If you do not agree, do not play. Consolidated Monolith Dynamics, its policies, memos, and personnel are fictional and are part of the Game’s fiction, not part of this contract. This section is the only place where we will say that with a straight face.
2. Your account
You must be at least 13 years old to play, and at least 18 (or the age of majority where you live) to make purchases. You are responsible for your account and for keeping your sign-in method secure. You can play as a guest without an account; guest progress is stored on your device and may be lost if your browser storage is cleared, which is your responsibility, not ours.
3. The free tier and purchases
The Game offers a free daily allowance of scenes, paid day passes, subscriptions, and consumable items. All prices are shown before purchase. Payments are processed by Stripe.
- Day passes unlock unlimited play until the end of the current game day (the daily reset time shown in the Game), not for 24 hours from purchase. A pass bought late in the day is short. The Game tells you this before you buy; so do we, here.
- Subscriptions renew automatically each period until cancelled. Cancel any time via the billing portal in the Game (Payroll Services); cancellation takes effect at the end of the paid period, and you keep access until then.
- Consumables (such as the Wellness Retreat) are spent when used and are never required to avoid losing; the same in-game effects are achievable through normal play.
Virtual items, turns, passes, and stats have no cash value, are not transferable, and are a limited license to features of the Game, not property. Except where the law requires otherwise, purchases are non-refundable; if something went wrong with a charge, contact us and we will look at it like people rather than like a policy.
4. AI-generated content
Scenes are generated dynamically by an AI model. That is the point of the Game, and it means content varies between players and sessions and may occasionally be odd, repetitive, or imperfect. Game content is fiction and entertainment. It is not advice of any kind, and it does not reflect the views of Neo Tomes Inc, operating as SPH Studios. If generation fails, the Game substitutes pre-written scenes so your session can continue; this is normal operation, not a defect.
5. Conduct
Do not: attempt to bypass the meter, entitlements, or payment systems; probe, scrape, overload, or reverse-engineer the service; use the Game to generate or extract content that violates law or our AI provider’s usage policies; or interfere with other players or our infrastructure. We may suspend or terminate accounts that do, and doing so forfeits unused virtual items.
6. Ownership
The Game, including its characters, writing, art, music, code, and the fictional company it depicts, belongs to Neo Tomes Inc, operating as SPH Studios or its licensors. We grant you a personal, non-exclusive, non-transferable license to play. You may share screenshots and recordings of your playthroughs, including commercially on video and streaming platforms; we would frankly like that. You may not sell the Game’s assets themselves or pass the Game off as yours.
7. Termination
You can stop playing and delete your account at any time. We can suspend or terminate access for breach of these Terms, and we can discontinue the Game or features of it; if we discontinue the Game entirely, we will make reasonable efforts to give notice, and where required by law we will refund the unused portion of active subscriptions.
8. Disclaimers and limits
The Game is provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent the law allows. To the same extent, Neo Tomes Inc, operating as SPH Studios is not liable for indirect, incidental, special, consequential, or exemplary damages, and our total liability for any claim relating to the Game is limited to the greater of $50 or the amount you paid us in the 12 months before the claim. Some places do not allow some of these limits, in which case they apply to the fullest extent permitted.
9. Changes to these terms
We may update these Terms. If a change is material, we will post it here, update the date, and give notice in the Game; continuing to play after the change takes effect means you accept it. If you do not, stop playing and, if you have an active subscription, cancel it.
10. The legal frame
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules, and disputes will be resolved in the courts located there, unless the law where you live gives you rights to your local courts that cannot be waived. If any part of these Terms is found unenforceable, the rest stands.
